These Terms of Use ("Terms") govern your access to and use of the EVA application and the website evabreathing.com (collectively, the "Service") provided by Mesh Flow LLCFZ, Meydan Grand Stan, Dubai, United Arab Emirates ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
EVA is a wellness application designed to support nervous system regulation through breathwork, guided meditation, and subconscious redirection techniques based . The Service is provided for personal, non-commercial use only.
EVA is not a medical device. It is not intended to diagnose, treat, cure, or prevent any medical or psychological condition. Nothing in the Service constitutes medical advice, psychological advice, or clinical treatment.
You must be at least 16 years of age to use the Service.
You agree to provide accurate information when registering, to keep your credentials secure, and to notify us promptly of any unauthorised use of your account.
New users receive 7 days of full access to all features of the Service at no charge. No payment information is required during the trial period. If you do not subscribe before the trial ends, access to the Service will end on day 8.
After the 7-day free trial, continued access to the Service requires a paid subscription. Options are: Monthly at €9.99 per month, Annual at €59.99 per year. All paid plans provide full access to all features of the Service.
Monthly and annual subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for unused periods of a subscription except where required by applicable law. The 7-day free trial is available once per user per device.
All content within the Service is the property of Mesh Flow LLCFZ or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial use only.
The Service is not a substitute for professional medical, psychological, or psychiatric care. If you are experiencing a mental health crisis, suicidal ideation, or any condition requiring clinical intervention, please contact a qualified healthcare professional or emergency services immediately.
Individuals with a history of epilepsy, seizure disorders, or sensitivity to binaural audio should consult a medical professional before using binaural tone features. Results vary and are not guaranteed.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Mesh Flow LLCFZ shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service.
Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim, or €50, whichever is greater.
You agree to indemnify and hold harmless Mesh Flow LLCFZ and its officers, directors, employees, and agents from any claims arising out of your use of the Service or breach of these Terms.
These Terms are governed by the laws of the United Arab Emirates, specifically the laws applicable in the Emirate of Dubai. Any dispute shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE, unless mandatory consumer protection law in your country of residence requires otherwise.
If you are a consumer in the European Union, you may also access the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
We may update these Terms from time to time. Material changes will be notified by email or through a notice in the app. Continued use after the effective date constitutes acceptance.
